Domestic Partnerships

Estate planning is even more important for same-sex couples than for married couples. If you are in a same-sex relationship and want your partner to inherit your property, you must have a will or trust that specifically names him or her.

Our firm can help you prepare a legal domestic partnership agreement that defines the contractual rights of each partner. Among other things, such an agreement can determine whether property is owned jointly or separately, how income is shared, and whether gifts or inheritances are held individually or jointly.

A domestic partnership agreement may also provide for the division of property and assets in the case of separation and offer dispute resolution options such as mediation or arbitration, which can offer significant benefits over litigation.

Powers of attorney for health care and property are also important legal documents for domestic partners: a power of attorney given to your partner will allow him or her to carry out your wishes if you require intensive medical treatment or manage your property if you become unable to do so.
